Terms of sale

This site "www.frantoiopetesse.it" it is owned by Az. AGR. "Antico Frantoio Petesse" of Petesse Maria Angela (later Antico Frantoio Petesse), with registered office in via Colle Scandolaro 29, 06034, Foligno (PG), ITALY, and VAT number 02081620540 and is dedicated to the retail sale of foodstuffs produced directly by the aforementioned farm, to the promotion of the agritourism activity of the same and to the promotion of other activities of the same farm.

Antico Frantoio Petesse observes the legislation on distance contracts referred to in art. 50 and following of Legislative Decree 206/2005.

We invite you to carefully read the conditions below, and print them and / or save them on a high durable medium of your choice.



General Conditions

All the methods of sale, delivery and payment are listed in detail in the various sections of the Site and are to be considered an integral and substantial part of this contract. The conditions applicable to each individual order will be those displayed on the Site at the time of the order itself. Any new conditions will be effective from the moment of publication on the Site and will apply only to sales concluded subsequently.



Offer to the public

All products and prices indicated on the Site constitute an offer to the public with the limitations and methods contained in the Site itself and in these general conditions of sale.



Product

The graphic design of the products delivered may not coincide with that represented on the Site in the event that the graphic design or shape of the packaging has been changed and the relative image on the site has not yet been updated w



Price

The cost of the Customer will apply the shipping rate depending on the country of destination, all prices shown are VAT included.

On-site collection is free at the point of sale located in:

Acceptance of orders

The order sent by the Customer will be binding for Antico Frantoio Petesse only if the entire order procedure has been completed regularly and correctly without any highlighting of error messages from the Site. Antico Frantoio Petesse will not include products not expressly ordered by the Customer, excluding gifts.



Order confirmation

In his e-mail box or his mobile phone number, the Customer will receive confirmation of the order placed with a summary of the products, their prices, and the general and particular conditions applicable to the order itself.



Cancellation and modification of the order

Antico Frantoio Petesse, following unforeseen logistical and organizational difficulties, may cancel the order by notifying the Customer by e-mail or, upon agreement with the same, change the day and/or time of delivery.



Delivery

Antico Frantoio Petesse delivers only to the areas specified by the GLS partner service.

Delivery times vary from 2 to 4 working days from receipt of notification of shipment, excluding for disadvantaged SCS and ZIP codes.

The order fulfillment times, that is, the time between the receipt of the order and the shipment by Antico Frantoio Petesse, may vary depending on the delivery area, the size of the order and other managerial variables. Normally they are carried out in 3-4 working days, except for force majeure.

For any anomaly found, the consumer can still contact Antico Frantoio Petesse directly at the references indicated in the Contact Area of the site.

Antico Frantoio Petesse will not be responsible for any delays during transport.

Likewise Antico Frantoio Petesse can not be held responsible for any loss, damage, incorrect or non-delivery caused by events and/or causes of force majeure or fortuitous events, such as by way of indication but not limited to: natural disasters, adverse weather conditions (such as heavy snowfalls), any strikes (of its own or other employees), accidents to means of transport, explosions, or any other cause, similar or different.

The risk of loss or damage to the goods, for reasons not attributable to the seller, is transferred to the consumer only when the latter, or a third party designated by him and other than the carrier, materially enters into possession of the goods.

In the event that the purchased good is not delivered or is delivered late, the consumer may invite Antico Frantoio Petesse to make the delivery within an additional period appropriate to the circumstances. If the additional period thus granted expires without the goods having been delivered to him, the consumer is entitled to terminate the contract, without prejudice to the right to compensation for damages. In this case, the consumer has the right to obtain a refund of any sums paid in execution of the contract. It is without prejudice to the possibility for the consumer to assert the rights referred to in ChapterIV



Available products and purchase restrictions

Antico Frantoio Petesse will not be in any way responsible for the temporary or definitive unavailability of one or more products. In the event of unavailability, even temporary, of the requested products, Antico Frantoio Petesse undertakes not to charge the Customer the corresponding price. The site highlights the cases in which limitations apply to the purchase of individual products.



Failure to Deliver

For delivery it is necessary the presence of the Customer or his representative at the address and within the time indicated in the order. If the Customer (or the person in charge) is not present, a second delivery attempt will be made and a storage practice will be opened in case of defined withdrawal failure. Antico Frantoio Petesse will not refund the cost of delivery and that of the products; Antico Frantoio Petesse will also exclude the Customer from the service.



Payment

As part of the Order submission process, Antico Frantoio Petesse may propose, at the sole discretion of the latter, different payment methods, such as, by way of example, payment by credit card (Visa, MasterCard, American Andpr The Customer will be required to indicate the method of payment, among those proposed by Antico Frantoio Petesse, which he intends to use.

If the Order is made by phone or by email, the payment of the price must be made by bank transfer to the account in the name of Antico Frantoio Petesse, whose bank details will be provided at the time of the order through the same means of contact. In these cases the order is to be considered confirmed, with the consequent taking charge by Antico Frantoio Petesse, only at the time of receipt of the credit on the aforementioned bank code.



Claim

According to Article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 n. 206, the Consumer can make use of an e giudizi

Before initiating the procedure and as a condition for the initiation of the same, the Consumer must submit a complaint to Antico Frantoio Petesse; if the Consumer does not receive a response within thirty days or if he has received an unsatisfactory response, the same may initiate the procedure.



Online Consumer Dispute Resolution (ODR)

In the case of a European consumer, it should be noted that the European Commission has made available to all residents of Europe a tool dedicated to alternative dispute resolution. Right of Withdrawal

The rights of the Customer are protected by Legislative Decree 206/2005.

The Customer has, therefore, the right to withdraw from the contract, even partially, without explanation and without additional costs, provided that the withdrawal is communicated by registered letter with return receipt to Antico Frantoio Petesse, Via Colle Scandolaro 29, 06034, Foligno (PG), ITALY or by e-mail to frantoiopetesse@gmail.com within 14 working days from the day of receipt of the products.

This communication must specify the desire to withdraw from the purchase and the product or products for which you intend to exercise the right of withdrawal, attaching a copy of the invoice.

The consumer will then be contacted by Antico Frantoio Petesse who will collect the products with costs at their own expense. The consumer must cooperate for the return of the products that must take place without undue delay and in any case within fourteen days from the date on which the withdrawal was communicated.

If the withdrawal has been exercised in accordance with the methods described, Antico Frantoio Petesse will reimburse the sum paid for the purchase of the product, net of delivery costs, as soon as possible and in any case within 14 days from the date on which Antico Frantoio Petesse became aware of the exercise of the right of withdrawal by the Customer.

However, in the event that the products do not possess the essential characteristics promised, present manufacturing defects, there have been errors in the delivery of the same or in any case it is due to Antico Frantoio Petesse, the shipping costs for the delivery of the purchased products and any right of cash on delivery will also be returned.

 

Accountability

Antico Frantoio Petesse guarantees compliance with quality standards and certifications relating to the products exclusively until the time of delivery to the place indicated by the Customer; any responsibility for the poor condition of the products due to improper storage after delivery is excluded.

Antico Frantoio Petesse declines all responsibility for direct or indirect damages of whatever nature they are or in whatever form they occur, resulting from the use of the Site and/or the news, photos and information contained therein and if the delivery takes place, at the request of the Customer, inside the house.



Privacy

Antico Frantoio Petesse will process the Customer's personal data in compliance with the legislation on privacy



Jurisdiction

Any and all disputes that may arise in relation to the application, interpretation and execution of these general conditions of sale, will be irrevocably devolved to the court of the place of residence or domicile of the consumer, if located in the territory of the State (Italy).
